The depositor undertakes to ensure that the deposited resources comply with the description given in section 3. Only SHS data produced within the framework of human and social sciences projects from French research will be accepted as resources deposited in the repository.
The depositor accepts that the repository may make copies of deposited resources for preservation purposes.
The depositor accepts that the repository may perform conversions on the deposited resources in order to preserve their readability over time.
The depositor undertakes to comply with current legislation concerning the rights associated with the resources deposited.
The depositor undertakes to inform the repository of any changes to the rights associated with the resources.
The depositor has the right to delete deposited resources. He/she must expressly request this from the repository, giving reasons, in particular in order to preserve the consistency over time of data linked to perennial identifiers.
The depositor has the right to publish resources deposited in the repository on other devices managed by other institutions.
The depositor has the right to embargo the distribution of resources for a limited period of time (see documentation).
The depositor has the right to terminate his commitment to the repository in the event of non-compliance with the repository’s obligations (see section 8).
Transfer of responsibility for resources¶
In the event of a change in the depositor’s situation, it is the depositor’s institution at the time of deposit’s responsibility to appoint a person to be responsible for the resources deposited.
Associated costs¶
Deposit in the repository is free of charge.
Validity and duration of the agreement¶
The respective commitments of the parties are valid upon signature of this agreement by both parties and are valid “sine die”.
Both parties may freely terminate this agreement by written notice. This agreement will terminate 60 days after such notification.
In the event of repository closure, the respective commitments of the parties are terminated, and resources will be transferred in accordance with the repository plan (see https://documentation.huma-num.fr/meta/plan-migration).
Repository rights and obligations¶
The repository undertakes to preserve and distribute the resources deposited during the term of the commitment to the best of its ability.
Insofar as possible (see section 5), the repository undertakes to keep the deposited resources unchanged from their original format. Nevertheless, the repository reserves the right to convert all or part of the resources in order to preserve their readability if necessary.
The repository has the right to broadcast the identity of the depositor of a resource.
The repository has the right to distribute information concerning the resources deposited.
The repository undertakes to provide a DOI-type Persistent IDentifier (or PID) and to maintain it over time for deposited resources.
Within the limits of its capacities, the repository ensures the implementation of appropriate technical measures to prevent modification of resources or access to them when they are protected by unauthorized third parties.
The repository has the right to withdraw resources in the event of non-compliance with the depositor’s obligations (see section 5).
The repository has the right to break its commitment to the depositor in the event of non-compliance with the depositor’s obligations (see section 5). Responsibility for the resources would then be transferred under the conditions described in section 6.
Competent jurisdiction in the event of conflict¶
In the event of conflict, French law shall apply. The warehouse has no legal personality of its own and will be represented by its main supervisory body: the CNRS.
